Suggestions Please!!
Friends; I ordered three months ego a 2004 330Ci BMW, in gray metallic; with the following packages Premium, Cold, Xenon lights and Sport. Now I have noticed the paint is fading on the rough and on the hood as well. It has white cloudy kind of patches on it. I took it the dealership and they looked at it, and they agree that the paint it getting bad. But they don’t seem to be willing to do something about it. They said; they will call the BMW and they need to look at it.
And I need everybody’s kind and sincere Suggestions regarding to this problem. What can I do; I don’t want them to repaint my new car, it has less then 3000 miles on it. What you folks think; is it possible that BMW will give me a new car or give my money back.
Do I need a attorney?

Thank you,
moonjunction

First of all I like to express my appreciation to the following forum members who took their time and replied to my question.

This is the current station, the BMW guy came and looked at my car and; he offered to repaint the spotted areas. And they estimated at the retail it will cast around $1,340 if I get it fixed some where else. But they are willing to paint it at one of their dealerships if I want to.
Now my question is; if I repaint my new car. Am I going to loss money if I needed to trade in or sell it in future? What you friends think what I should do now.

In advance I appreciate you all for your kind suggestion and ideas.

I do not think they will give you your money back, I think they will re-paint as necessary. Maybe if you and your dealer can agree to another car they might convince the BMW NA guys to let you swap cars. I do not think an attorney is going to be much help.

I agree with Dan, they'll probably won't give you your money back. Considering repainting the car will hurt your resale value, it would be a better option if you work something out with your dealership for a new car.

It might be a defect, but the remedy would be a repaint. It's not like a toaster that you can just return. Like Tom said, best option is to try and work out a deal to get credit for your car and get into a new one.

Do they think it is an actual paint defect? The “cloudy” part makes me think it could be similar to what I experienced. I would go to an independent shop and have them evaluate the paint also.

What you are talking about sounds so much like a problem I had and the uncertainty I experienced with my new car. What happened with mine is that the car was poorly prepared and the protective spray was not removed correctly. BMW paid the bill, around $400-500, for a professional detail shop to clean up the paint.

BMW wanted a dealer to do the work and I told them that a BMW dealer already had a chance to do this right and failed. The next day I had a check in hand via FedEx and the car looked spectacular when it was finished.

I initially thought I had a serious paint problem. And it was only after finding a knowledgeable person that I found out it was not an actual paint problem.

Oh yeah, and the dealer acted like they were completely stumped by what had happened to my paint, but be assured, BMW the company pays for these repairs routinely, or so I gathered after a number of conversations.
